Dangerous Roads / Hazardous Conditions
Accidents involving serious injuries are not always due to other negligent
drivers. In many cases, people have suffered damages due to dangerous
and hazardous road conditions that cause the vehicle to crash. Federal,
state and local agencies have a responsibility to provide safe roadways
that are clearly marked and warn of dangers such as detours, roadwork,
uneven pavement, grooved pavement, abrupt lane changes, steel plates,
and so on.
Even though construction, repair and maintenance is a common occurrence on
most major highways and roads throughout the United States, it can pose serious
dangers if drivers do not know of the dangers associated with it.
If you have suffered damages as a result of a dangerous or hazardous road condition,
you may be able to recover your losses including property damage, medical expenses,
pain and suffering, loss of current and future wages, and loss of future enjoyment
if you are able to establish that the agency responsible for maintaining the
road was negligent.
Your ability to make a claim for personal injury rests upon three factors:
- First is liability, that is, who caused the accident and is legally responsible;
- Second is the establishment of an amount of damages to which you are legally
- Third, the ability to collect the damages, specifically what sources, such
as insurance or individual assets, are available for payment of a settlement
or damage award.
In many cases, road hazards will "disappear" overnight,
and proving your case often depends on proper documentation. You
must inform the responsible party verbally and in writing, and you
must be able to show proof that there was, in fact, a negligent
and hazardous condition present when the accident occurred. Make
sure you gather as many witnesses to the accident as possible and
always take pictures of the scene before any evidence can be removed.
These cases often involve a claim against a governmental entity.
The law requires that claims against a governmental entity be filed
promptly and follow very specific procedures. Here, the time limit
is extremely short, (as little as 120 days), so it's important that
you act right away. As attorneys, we help our clients establish
